What quorums are required for each type of majority in co-ownership?
Each decision at the general assembly requires a specific quorum and majority depending on its nature.
The Belgian Civil Code provides for several majority levels depending on the importance of the decision.
Simple majority (50% + 1): Routine decisions such as approval of accounts, the budget forecast, routine maintenance and appointment of the syndic.
Two-thirds majority: Works on common areas beyond routine maintenance, modification of internal regulations.
Four-fifths majority: Modification of the base deed, change in the distribution of shares, and sale of a common part.
Unanimity: Change of building purpose and dissolution of the co-ownership. Unanimity requires the consent of all co-owners, not just those present.
